Additional terms and conditions for Croatia Sailing trips

IMPORTANT NOTICE TO GUESTS: THIS DOCUMENT IS THE CONTRACT BETWEEN YOU AND CARRIER AND CONTAINS IMPORTANT LIMITATIONS ON YOUR RIGHTS. THIS IS A LEGALLY BINDING DOCUMENT. PLEASE READ CAREFULLY.

1. INTRODUCTION

This Contract contains all the terms of agreement between you and Carrier. The acceptance and/or use of this Contract by the person named hereon as Guests shall be deemed to be an acceptance and agreement by each of them of all of the terms and conditions herein.

The person purchasing, accepting and/or named on the Contract represents that he/she is authorized by all named Guests, including any minor, to accept and agree to be bound by all the terms and conditions of the Contract. This Contract is not transferable and you may not sell or assign it. It is valid only on the Yacht and for the voyage indicated. This contract may not be modified except in writing signed by Carrier.

The terms, conditions and limitations herein shall apply to any and all disputes between you and Carrier regardless whether arising aboard the Yacht or in any other place, location or mode of transportation whatsoever.

All rights, defenses, disclaimers and limitations of liability set forth herein shall inure to the benefit of the Carrier and all concessionaires, independent contractors or other providers of any services or facilities in connection with or incident to the Guest’s voyage, as well as any of their affiliated or related companies, parents, subsidiaries, successors, assigns or fictitiously named entities; and all suppliers

2. DEFINITIONS

“Carrier” means and includes the owner, Katarina Line d.o.o., tax ID number – OIB: 28922587775, corporate registration ID – MB: 040009767. Official records confirm KATARINA LINE d.o.o. as a valid business.

“You, Your, Guest” means the person(s) purchasing, accepting or using this Contract or who board(s) the Yacht or those in their care, and includes and binds their heirs, successors in interest and personal representatives. Throughout this Contract, use of the singular includes the plural and use of the masculine includes the feminine.

“Voyage” means the sailing from the port of departure to the final port of disembarkation, including any rail, road or sea port, any land accommodation components or package sold with, or included in the price of or taken in connection with the Voyage, any shore excursions or shore side facilities related to or offered during the Voyage, and all transportation to or from the voyage if purchased through or arranged by Carrier.

3. COMPLAINTS

Any complaints regarding service on board have to be given directly to the vessel/ hotel on the spot and through the official representative of KATARINA LINE.

Complaints have to be certified by the vessel/ hotel, written in the complaints book, and sent to KATARINA LINE within 15 days from the customer’s departure. On the contrary, such complaints will not be taken into consideration.

4. SPECIAL NOTES

  • The captain reserves the right to change the route in case of bad weather conditions.
  • Passengers must follow ship rules (to be found in written form on the ship), especially with regard to not bringing drinks on board, and in case of bad behaviour, KATARINA LINE/ captain reserves the right to ask clients to disembark.
  • Before departure, the KATARINA LINE representative is obliged to perform a welcome speech providing important information on safety on board, and other information required by law for all the passengers aboard.
  • Passengers agree to abide by the decisions and instructions given by the tour leader, who reserves the right to change the itinerary in agreement with the captain according to weather conditions.
  • KATARINA LINE is not responsible for any accidents that may occur onboard and insists that clients are informed of this and the need for extra observation and caution whilst being onboard or walking between vessels and the mainland.
  • Due to specific mooring conditions and requirements in some Croatian ports, Katarina Line ships are moored side by side, making it necessary for the clients to cross from one ship to another with gaps in between ships to get to the shore. In such cases, passengers need to take special care when crossing and do this at their own risk. Crew assistance will be given to those needing and request it.

5. VESSEL RULES

  • Katarina Line/vessel owner is obliged to have the entire vessel disinfected before the season begins by an official company, and will provide a certificate. Extra care will be taken during weekly cleaning with a special disinfectant against bedbugs. In case there is an outbreak in one of the cabins, the client/s will be moved, their belongings sent to the cleaners and given another cabin to sleep in if one is available. If all cabins are occupied, a sleeping bag or similar will be provided. No compensation will be given as the vessel cannot be held responsible for an outbreak. The captain will cover the cost of the passengers’ clothes being cleaned.
  • Katarina Line shall ensure that it, along with its representatives, subcontractors, and service providers, consistently operates in accordance with the minimum health and safety standards as prescribed by Croatian law or equivalent regulations. This includes all applicable measures to safeguard the health, safety, and well-being of its customers.
  • Passports are to be handed to the captain for registration on the first day of the cruise.
  • Jumping or diving from the ship during navigation is strictly forbidden. For safety reasons, climbing on the masts is also forbidden.
  • During rough weather, movement should be minimised and done with care, as floors can often be wet and slippery.
  • Passengers should take extra care when crossing between the ships when the ships are docked alongside in port. It is advised to ask a crew member for assistance when crossing. Note that movement between vessels is the individual’s responsibility. Safety belts are placed under the seats in the dining area and/or under the bed in the cabins or in the wardrobe, depending on the vessel.
  • As vessels are acoustic, passengers are asked to behave accordingly. Special attention must be given to the night peace onboard, which officially starts at midnight and in National Parks, night TERMS OF SERVICE | katarina-line.com peace is required even earlier, and passengers will be notified accordingly.
  • Smoking in the restaurant area and in the cabins is not permitted. Smoking is allowed on the deck in designated smoking areas only, but passengers must not throw cigarette butts in the sea.
  • Bed linen and other items are not to be moved from the cabin.
  • Only toilet paper is allowed to be thrown in the toilet.
  • Passengers are not permitted to bring food and drinks aboard. This includes any drinks and food purchased on shore in ports of call. The only exceptions are personal care products, medicine, food products specifically for infants, and food products for special diets. Typical regional products purchased during port visits will be stored onboard and returned to passengers at the end of the cruise.
  • Passengers are obliged to respect mealtimes, which will be placed on the notice board in the dining area, as well as departure times from ports.
  • To maintain a clean and comfortable environment, refrain from entering the ship while wet from the sea. This policy extends to cabin areas as well. Please ensure you are dry and in suitable clothing before accessing interior areas (no swimwear).
  • Clients are responsible for looking after their personal belongings whilst travelling. Katarina Line cannot be held responsible for any personal belongings left behind or damaged, irrespective of the circumstances.
  • Any damages must be compensated by the passenger. Lost cabin keys will be charged for.
  • It is strictly forbidden to throw any rubbish into the sea.
  • Water is limited on board, please be very rational with it. The same applies to electricity, which runs on the generator.
  • Portholes in lower deck cabins must be closed during navigation to avoid getting wet with seawater entering the cabin through the porthole.
  • Hot Tub to be used according to the written instructions onboard.
  • Jumping from the sun deck is strictly forbidden
  • The captain and the crew will be available for any questions or queries and will do their utmost to make your stay onboard a most pleasurable one. If the captain and his crew are not providing satisfactory service, please contact the Katarina Line office for further help, as we aim to make passengers satisfied during the cruise.
  • Service charge is not included in the price and therefore please tip at your own discretion.
  • The captain has the right to change the itinerary in case of bad weather or similar inappropriate conditions in ports to ensure safety on board.

6. FORCE MAJEUR

If the vessel is unable to set sail as scheduled for reasons beyond Carrier or Solo Female Travelers control, a suitable replacement vessel of the same or higher category will be arranged at no extra cost to the Guests.

If a vessel of the same or higher category is not available, Katarina Line will provide appropriate alternative accommodation, either on land or at sea. No further compensation will be provided.

If the replacement vessel is of lower quality, the cruise price will be adjusted accordingly to reflect the difference in quality. Katarina Line’s liability is strictly limited to the price of the cruise. Should Katarina Line be unable to provide a replacement vessel at the start of the cruise or during the cruise due to technical issues, the Carrier may take up to 24 hours to perform necessary repairs. During this period, client complaints will not be accepted. Refunds will not be provided if an alternative vessel is not of the same or higher category.
